The Balmoral House case stands out as one of the most challenging scenarios faced by city officials. This property was not merely a single structure; it had morphed into a makeshift, lawless community, housing numerous individuals and animals in sub-standard living arrangements. Residents were found in RVs, cars, crawl spaces, tents, and even a garage that may have been repurposed as living quarters. Between 2018 and 2020, the San Diego Police received over 80 calls about activity at the property, which had become a dumping site and a hotbed for crime, contributing to feelings of lack of safety and security in the community. 

This situation required more than just standard code enforcement measures. The complexities of multiple occupants and concerns around health and safety regulations created an urgent need for a strategic approach. By orchestrating a solid plan and facilitating communication between city officials and stakeholders, Griswold Law was instrumental in crafting a solution that ensured the safety and well-being of all involved.

The Bellafonte Resort Challenge

Initiated by the lender rather than the municipality, this situation was fraught with health and safety concerns and presented significant hurdles. The once-quaint Bellafonte Resort had become a major problem for the community, with reports of squatters, drug activity, and dog fighting, leading to loud and frequent calls for intervention from both neighbors and local authorities. From 2020 to 2021, almost 150 calls for service to the sheriff's department were reported. 


Griswold Law worked closely with law enforcement, including a SWAT team, to address the many pressing issues in order to secure the property so remediation could begin. This collaborative effort aimed to restore safety and order so that removal of hazardous conditions that threatened the surrounding community could begin, underscoring the importance of proactive enforcement strategies. 

The Desert Hot Springs Hotel Saga

This property presented extreme challenges for the city and highlighted the essential role of code enforcement to ensure public safety. Issues such as non-compliance with a conditional use permit, criminal activities, and poor maintenance led to multiple notices and citations, with worsening conditions endangering adults and children who were found to be illegally occupying the property. Widespread structural issues were cited, causing officials to fear a potential collapse of the building. The Hotel was declared a major public nuisance and an immediate threat to occupants and the public. 

 

Once the court appointed the Griswold Law team as receiver to assume control of the property, the team put a plan into place, securing a buyer with experience in hotel restoration. Griswold Law continues to oversee remediation and will monitor progress throughout City sign-off. Through combined efforts, significant improvements have been made to the property, demonstrating the power of collaboration in addressing public nuisances.
